These Terms of Service ("Terms") govern your access to and use of the website at obsidianwebco.com (the "Site") and any services provided by Obsidian Web Co. ("we", "us", "our"), a sole proprietorship owned by Drake Ryan and based in Lynchburg, Virginia. By using the Site, you agree to these Terms.

1. Use of the Site

You agree to use the Site only for lawful purposes and in a way that does not infringe the rights of, restrict, or inhibit the use of the Site by any third party.

You may not:

• Attempt to gain unauthorized access to any portion of the Site
• Use automated systems (bots, scrapers, crawlers) in a way that harms the Site or consumes disproportionate server resources
• Submit malicious code, spam, or deliberately misleading information through any form
• Reproduce, duplicate, copy, sell, or resell any portion of the Site without our prior written consent

2. Intellectual Property

All content on the Site — including text, graphics, logos, images, code, and the Obsidian Web Co. name and mark — is the property of Drake Ryan d/b/a Obsidian Web Co. or its content suppliers and is protected by U.S. and international copyright law.

3. Third-Party Services

The Site uses the following third-party services, each governed by their own terms:

• Google Analytics 4 — aggregate anonymized traffic analytics
• Microsoft Clarity — anonymized behavioral analytics
• Formspree — contact-form processing
• Google Fonts — typography delivery
• Vercel — hosting

4. Client Services

Obsidian Web Co. also provides paid web design and development services under a separate Client Services Agreement executed per project. These Terms govern only your use of the Site. Paid client work is subject to the project-specific agreement you sign before work begins.

5. Disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, we make no warranties, express or implied, about the operation of the Site or the information, content, or materials included on it.

We do not warrant that the Site will be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable. Nothing on the Site constitutes legal, financial, or professional advice.

6. Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Obsidian Web Co., Drake Ryan, or any affiliates be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site. Our total liability for any claim shall not exceed $50.00 USD.

7. Indemnification

You agree to indemnify and hold harmless Obsidian Web Co., Drake Ryan, and any affiliates from any claim or demand — including reasonable attorneys' fees — made by any third party due to or arising out of your breach of these Terms or your violation of any law or the rights of a third party.

8. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Virginia. Any dispute shall be brought exclusively in the state or federal courts located in Lynchburg, Virginia, and you consent to the personal jurisdiction of such courts.

9. Changes to These Terms

We may revise these Terms at any time. Changes take effect when posted to this page, and the "Last updated" date is revised. Continued use of the Site following any change constitutes acceptance of the revised Terms.
